Got an answer back from Sales Mgr. of Kentuckiana Yacht Sales in Kentucky. He informed me that the Jeffersonville Indiana Kentuckiana operation is not part of their organization and he can't help. Sorry I was not aware there were 2 organizations with the same name.

The fellow you got is the sales manager for the Louisville office . Call Leon Shaw, he owns the whole outfit. He is the man with the final say. He is 100% owner as he bought Brummett out. Call him.

went through a simular situtation years ago. i went to see an attorney and he advised me of a littlie known law called retutribution not sure of spelling. to make a long story short sued under retutribution and won. might want to see an attorney. from what i understand retutribution is when there is a hidden or laten defect not visibile at time of sale. worth a shot.

Each State has its own laws concerning this. Some have almost none. Retribution means payback recompense or reward,something given or exacted in recompense[/i] ; especially : PUNISHMENT . In your case they were more than likely aware of the defect and tried to cover it up. Did she buy from the salesman or from the Company? Was the boat sold as is? They would counter with personal neglect as she should have looked at it. What I am saying is it could be settled with Kentuckiana, if she actually bought from them. Again legal fees could make it a negative result. I think the principle would override the cost in most cases. I would bet that her paperwork shows she bought from the individual.

Any time lawyers get involved I;m reminded of the 2 fellows who found the clams on the beach. They wouldn't agree on dividing them up, so they hired a lawyer. YEP! He took all the meat for his fee & left them the shells. ted65538916.3367939815
