The Navigation Rules apply to all Vessels on the water of the the United States and for a vessel owned in the United States on the high seas.Any boat 12 meters or 39.4 Ft.must have a copy aboard.The penalty for failure to do so can be as much as $ 5.000.What I want to know is Chapter 23 Sec. 2302. A person operating a vessel in a negligent manner that endangers life ,limb. Or PROPERTY of a person is liable to United States Goverment for a civil penality of not more than $1.000.But a person Operating a vessel in a GROSSLY negligent manner that endangers life ,limb Or PROPERTY of a person shall be fined not more than $5.000 imprisoned for not more than one year or both.When do you step over the line from negligent to grossly negligent?

Inland rules leave the determination to the inspecting officer, and the amount of danger and damage as determined by said officer. Do you have a case involving this? I can guarantee you that as for he rules being on board boats of 40 ft and up in round figures that one in 10 inland may comply.

From what I have seen over the years 1 in 10 with rules is right.The State I am in says reckless operation is defined as any act which endangers life,limb,or property.Its is punishable by a fine of $2.500 and six months in jail.Additionally the Coast Guard may impose the $5.000 and imprisonment of one year.That is in the State boating book.
